SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on May 6, 2013, BRYAN WALDEN and KELLY GAVIN executed a Deed of Trust to JOHN R. GUNN, Trustee for FIRST STATE BANK, which is recorded in Deed of Trust Book 348 at Page 841 in the land records in the office of the Chancery Clerk of Clarke County, Mississippi; and
WHEREAS, on June 27, 2014, KELLY GAVIN executed a Warranty Deed to BRYAN WALDEN, which is recorded in Deed Book 275 at Page 183 in the land records in the office of the Chancery Clerk of Clarke County, Mississippi; and
WHEREAS, FRED ANTHONY MONSOUR, was appointed Substitute Trustee in the place and stead of JOHN R. GUNN, in said Deed of Trust by instrument dated September 8, 2022, and recorded on September 16, 2022 in Substitution of Trustee Book 4 at Page 320; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substitute Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale.
NOW THEREFORE, I, FRED ANTHONY MONSOUR, Substitute Trustee in said Deed of Trust, will on OCTOBER 27, 2022, offer for sale at public outcry, and sell within legal hours, (being between the hours of 11:00 A. M. and 4:00 P. M.) at the front entrance of the County Courthouse of the County of Clarke, State of Mississippi, to the highest and best bidder for cash, the following described property lying and being situated in the County of Clarke, State of Mississippi, to-wit:
Commencing at the NE corner of Section 13, Township 4 North, Range 14 East, and run West 4361.59 feet, thence South 1811.17 feet to a point situated on the Easterly right of way line of U.S. Highway No. 11, thence run South 32 degrees 50 minutes 06 seconds West along said Easterly right of way line of U.S. Highway No. 11 for 78.79 feet to the point of beginning of the property herein described, from said point of beginning run South 32 degrees 50 minutes 06 seconds West along the Easterly right of way line of U.S. Highway No. 11 for 210.0 feet, run thence South 84 degrees 45 minutes 24 seconds East for 282.68 feet, run thence North 5 degrees 14 minutes 36 seconds East for 186.12 feet, run thence North 84 degrees 45 minutes 24 seconds West for 185.41 feet to the point of beginning, containing 1.0 acre in the West 1/2 of Section 13, Township 4 North, Range 14 East, Clarke County, Mississippi.
I will convey only such title as is vested in me as Substitute Trustee.
