ORDINANCE NO. 91
ORDINANCE AMENDING ORDINANCE NO. 89, ESTABLISHING RATES FOR GARBAGE PICK-UP SERVICE FOR THE TOWN OF ENTERPRISE, MISSISSIPPI, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the Mayor and Board of Aldermen of the Town of Enterprise, Mississippi, heretofore did adopt Ordinance No. 89 establishing rates for residential and non-residential garbage pick-up service within the Town; and
WHEREAS, it is now necessary and proper that the said Ordinance No.89 now further be amended so as to provide for appropriate new and adjusted rates and other charges for the service of the garbage pick-up service of the Town of Enterprise, and to provide for the implementation and enforcement of certain policies and procedures with respect thereto, all for the benefit of the health, welfare and safety of the citizens thereof; and
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Aldermen of the Town of Enterprise, Mississippi, as follows:
Section 1. That Section 1 of Ordinance No. 89 now be and the same is hereby deleted in its entirety, and there be substituted in lieu thereof the following as a new Section 1 thereof.
“Section 1. That there is hereby established the following rates to be charged by the Town of Enterprise, Mississippi, for garbage pick-up service as follows:
$19.75 per 96-gallon cart per month.
Businesses may choose:
96 gallon cart, $19.75 monthly
4 yard bin, $118.00 monthly
6 yard bin, $145.00 monthly
8 yard bin, $160.00 monthly
MANDATORY APPROVED CONTAINER UTILIZATION; PROHIBITION ON USE OF UNAPPROVED, UNPROVIDED CONTAINERS
All residential and non-residential customers for garbage and trash picked up for disposal within the Town, whether commercial or non-commercial in nature, shall utilize for such purpose only an approved 95/96-gallon container specially provided on the Town’s behalf by its designated waste disposal contractor. Every residential and non-residential customer shall be provided with the first such approved container at no charge. Additional containers or replacement containers may be provided at additional cost, the payment of which shall be the sole responsibility of the customer(s) receiving the same. The use of approved, Town or contractor-provided containers is mandatory, and the use of unapproved, unprovided containers is prohibited. Any trash or garbage not placed securely within an approved and provided container is subject to not being picked up.
Late Charge: The Town shall assess and collect a late charge equal to ten percent (10%) of the outstanding balance on all bills paid after the tenth day of the calendar month.
All garbage and trash generated by any customer (regardless of residential or non-residential) shall be securely placed and maintained in an approved 95/96-gallon container provided on the Town’s behalf by its designated waste disposal contractor, securely fastened and placed street side on the normally scheduled pickup day.
Loose, leaking or otherwise unsecured garbage or trash is subject to not being picked up. No garbage will be picked up from fixed-in-place containers at the street side. Permanent, fixed-in-place containers shall be removed from the Town’s right-of-way, and failure to so remove the said containers shall subject the owner thereof to a fine of $50.00 per month until such time as the container is removed. The approved, provided containers shall be removed from the right-of-way within a reasonable amount of time after the trash and garbage pickup. No durable container shall be placed street side and used as a fixed-in-place container.
In the event that the regularly scheduled pickup day is a legal holiday, garbage will not be picked up until the next scheduled garbage pickup day unless otherwise directed by official action taken by the Board of Aldermen. Notices of changes in the regular pickup dates for garbage may be given by annotating the same on citizen’s water bills or by publication in a newspaper having general circulation within the Town of Enterprise.
