SPECIAL COMMISSIONER’S NOTICE OF SALE
WHEREAS, on December 16, 2016, Stephen Butler, an unmarried man, executed a Deed of Trust to Evans & Monsour, PLLC, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., as Beneficiary, as Nominee for GMFS, LLC, its successors and assigns, which deed of trust is recorded in Deed of Trust Book 375 at Page 754, in the Office of the Chancery Clerk of the County of Clarke, State of Mississippi; and
WHEREAS, said Deed of Trust was last sold, assigned and transferred to Lakeview Loan Servicing, LLC, by Assignment recorded October 9, 2026 in Book 431 at Page 788 in the Office of the aforesaid Chancery Clerk.
WHEREAS, by Default Judgment in Cause No. 25-cv-00196-AT, dated March 25, 2026, McCalla Raymer Leibert Pierce, LLP, was appointed Special Commissioner therein, recorded in the Office of the aforesaid Chancery Clerk in Book 324 at Page 84; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said Deed of Trust, the undersigned Special Commissioner will execute the trust and sell said land and property in accordance with the terms of said Deed of Trust and the above referenced Default Judgment for the purpose of raising the sums due thereunder, together with attorney’s fees, Special Commissioner’s fees and expense of sale;
NOW, THEREFORE, WE, McCalla Raymer Leibert Pierce, LLP, Special Commissioner in said deed of trust, will on the 14th day of May, 2026, offer for sale at public outcry for cash to the highest bidder and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) at the West Front Door of the Clarke County Courthouse located in Quitman, County of Clarke, State of Mississippi, the following described property situated in the County of Clarke, State of Mississippi, to-wit:
Beginning at the NW Corner of the NE 1/4 of SW 1/4, Section 28, Township 4 North, Range 15 East; run thence East 314 feet, thence run South 16deg 30' West for 329 feet; thence run South 35deg 32' West for 30 feet; thence run South 36deg 15' West 334 feet; thence run North 618 feet to the Point of Beginning, containing 2.7 acres, more or less, in the NE 1/4 of the SW 1/4 of Section 28, Township 4 North, Range 15 East, Clarke County, Mississippi.
LESS AND EXCEPT part to Carney described as: Township 4 North, Range 15 East, Section 28:
Commencing at a point situated 204.0 feet South of the NW Corner of the NE 1/4 of the SW 1/4 of Section 28, Township 4 North, Range 15 East in Clarke County, Mississippi and run thence South 63deg East for 245.0 feet; thence South 35deg 32' West for 30.0 feet to the Northerly right-of-way of the Stonewall-Clarkdale Public Road; thence run in a Southwesterly direction along the said road for 334.0 feet; run thence North along a fence for 414.0 feet, more or less, to the Point of Beginning.
WE WILL CONVEY only such title as is vested in McCalla Raymer Leibert Pierce, LLP as Special Commissioner.
