ORDINANCE AMENDING ORDINANCE NO. 140 DATED SEPTEMBER 3, 2024, ORDINANCE AMENDING ORDINANCE NO. 135, DATED SEPTEMBER 14, 2021, ORDINANCE AMENDING ORDINANCE NO. 129, DATED NOVEMBER 7, 2017, ORDINANCE AMENDING ORDINANCE NO. 128, DATED MAY 9, 2017, ORDINANCE AMENDING ORDINANCE NO. 127, DATED MAY 2, 2017, ORDINANCE AMENDING ORDINANCE NO. 125, DATED AUGUST 2, 2016, ORDINANCE AMENDING ORDINANCE NO. 123, DATED FEBRUARY 3, 2015, ORDINANCE AMENDING ORDINANCE NO. 121, DATED SEPTEMBER 26, 2014, AMENDING ORDINANCE NO. 118, DATED SEPTEMBER 3, 2013, AMENDING ORDINANCE NO. 114, DATED FEBRUARY 1, 2011, AMENDING ORDINANCE NO. 113, DATED NOVEMBER 2, 2010, AMENDING ORDINANCE NO. 112, DATED NOVEMBER 7, 2006, AMENDING ORDINANCE NO. 111, DATED SEPTEMBER 6, 2005, AMENDING ORDINANCE NO. 110, DATED MARCH 2, 2004, AMENDING ORDINANCE NO. 83, DATED JULY 2, 1991, AMENDING ORDINANCE NO. 77, DATED OCTOBER 6, 1987, AND AMENDING ORDINANCE NO. 67, DATED APRIL 1, 1986, BY STRIKING FROM SAID ORDINANCES THE RESPECTIVE SECITONS 1 OF SAID ORDINANCE NO. 77 AND ORDINANCE NO. 83 AND BY STRIKING THE SECTION 2 OF SAID ORDINANCE NO. 67, ALL IN THEIR ENTIRETY, AND SUBSTITUTING NEW SECTIONS IN LIEU THEREOF, SO AS TO PROVIDE FOR NEW AND ADJUSTED RATES AND OTHER RELATED CHARGES FOR THE SERVICE OF THE COMBINED WATERWORKS AND SEWERAGE SYSTEM OF THE TOWN OF STONEWALL, MISSISSIPPI, AND TO PROVIDE FOR CERTAIN POLICIES AND PROCEDURES TO BE IMPLEMENTED AND ENFORCED IN CONNECTION THERETO, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH.
WHEREAS, the Water Ordinance No. 67 on April 1, 1986, and same has been amended over the years by ordinances No. 77, No. 83, No. 110, No. 111, No. 112, No. 113, No. 114, No. 118, No. 121, No. 123, No. 125, No. 127, No. 128, No. 129, No. 135, and finally No. 140, it has become necessary that they all should be amended by this Ordinance No. 143 to provide for the appropriate new and adjusted rates and other changes for the Combined Waterworks and Sewerage System of the Town of Stonewall, and to provide for the implementation and enforcement of certain policies and procedures with respect thereto, all for the benefit of the health, welfare and safety of the citizens thereof.
NOW THEREFORE, BE IT ORDAINED by the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, as follows:
Section 1. That Section 1 of Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114, Ordinance No. 118, Ordinance No. 121, Ordinance No. 123, Ordinance No. 125, Ordinance No. 127, Ordinance No. 128, Ordinance No. 129, Ordinance No. 135 and Ordinance No. 140 all now be and the same are hereby deleted in their entirety, and there be substituted in lieu thereof the following as a new Section 1 of each thereof:
“Section 1. That Section 2 of Ordinance No. 67, dated April 1, 1986 be and said section is hereby deleted in its entirety and there be substituted in lieu thereof the following:
“Section 2. That from and after the effective date hereof, water and sewerage rates and charges to both residential and commercial customers or users of the Combined Waterworks and Sewerage System, or any additions or expansions thereof, of the Town of Stonewall, Mississippi shall be as follows;

Thereafter, all reference to discounted rates for any commercial business located within the Town of Stonewall and any calculation of any discounted rate are hereby repealed and thus omitted.
Any business that conducts fire protection sprinkler test may apply to the Board for a 100% adjustment to the sewer percentage of the monthly bill equal to the amount of water used for the sprinkler test.

POLICIES AND PROCEDURES
The following policies and procedures shall be implemented and enforced:
All new applicants for service from the combined waterworks and sewerage system of the Town of Stonewall shall complete and submit to the Town Clerk a written application therefor, in such form as shall be approved by the Mayor and the Board of Aldermen.
Industrial process waste will not be permitted unless adequately treated.
Town personnel shall read all meters on or about the time period between the tenth and fifteenth days of each calendar month. Billings shall be prepared therefrom and in due course thereafter submitted to customers for payment.
Payment of all charges for water and sewer service reflected on bills already submitted by the Town to customers shall be due and payable in full not later than the tenth day of each calendar month. All accounts are payable by United States Mail, in person at the Town Hall, via phone payment with credit card or online.
The Town shall assess and collect a late charge equal to ten percent (10%) of the outstanding balance on all bills paid after the tenth day of the calendar month.
In the event a bill for water and sewer service remains unpaid as of the 15th day of the month, Town personnel shall discontinue service to the customer on the next business day thereafter.
In the event the Town discontinues service to a customer for delinquency of an account, as aforesaid, a $60.00 reconnect fee shall be assessed for reconnecting service after service has been cut off pursuant to this action.
In the event a delinquent account is referred to collection, the Town shall be entitled to recover all costs of collection, including collection fees, court costs and a reasonable attorney’s fee.
All applicants for service from the combined waterworks and sewerage System of the Town of Stonewall, shall agree in writing to follow the guidelines set by the Mississippi State Department of Health regarding onsite wastewater disposal.
No residential or commercial customer of the Town shall hook up a water service line or otherwise provide unauthorized water service to a non-metered residential or commercial structure through a single water meter. Upon violation, said customer shall immediately discontinue such non-metered
hook-up service and shall be subject to a fine of up to $50.00 per day for each violation.
There will be a one-time water leak adjustment per customer per fiscal year (October 1 through September 30). The adjustment will be on the sewer. All Customers requesting adjustment must provide an itemized receipt with signature from persons who repaired the leak. The Board must approve all adjustments.
All water customers are recommended to provide an emergency cut-off between the meter and their structure to minimize potential problems with the electronic water meter.
The Town will not make water adjustments for filling swimming pools, irrigating gardens or lawns, or washing vehicles.
A seal will be placed on the water meter when the water is turned off by the Town. If the seal is found to be broken, the customer whose name is on the account shall be responsible for paying the $75.00 tampering fee along with all other applicable fees.
SECTION 2. The Ordinances shall take effect and be in force one (1) month after its Passage, and all Ordinances in conflict herewith be and the same are hereby repealed.
