Final Notice and Public Explanation of a Proposed Activity in a [100-Year/500-year Floodplain or Wetland]

This is to give notice that the Town of Shubuta has conducted an evaluation as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant (CDBG). The proposed project(s) is located along Brown Street, Prosperity Street, and Eucutta Street, in Shubuta, Clarke County, Mississippi. The proposed project will include the following: rehabilitation and construction of wastewater services to include the rehabilitation of a pump stations, wastewater treatment plant equipment replacement, and 1,000 LF of new 8” cured in place pipe linear (CIPP) to seal cracked sanitary sewer pipes, reinstating service lines, and making pavement repairs as needed. The total number of acres of floodplain/wetland in the project area is approximately five (5) acre.
The Town of Shubuta has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: Alternatives considered by the town were: 1) proceeding with the project as described above; 2) taking no action to address the problem; and 3) relocating the project to other impacted areas within the Town. The town could not select alternative locations because the problems are located at the existing sewer lagoon along Brown Street, Prosperity Street, and Eucutta, in Shubuta, Clarke County, Mississippi. The city could choose not to proceed with the project, but the Town’s wastewater system would continue to be in need of repair to maintain the public health of citizens. The town has determined that there were no alternative methods to accomplish the project objectives because improvements are necessary to protect the health and safety of the local residents. This project will be in compliance with state and local floodplain/wetland protection procedures.
The Town of Shubuta has reevaluated the alternatives to building in the floodplain/wetland and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and/or 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains/wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains/wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains/wetlands, it must inform those who may be put at greater or continued risk.
