SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on August 8, 2012, James R. Ivy executed a certain deed of trust to National Title Insurance of New York, Inc., Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary as nominee for Freedom Mortgage Corporation of New Jersey which deed of trust is of record in the office of the Chancery Clerk of Clarke County, State of Mississippi in Book 0342 at Page 929 Instrument No. 201203005; and
WHEREAS, LOGS Legal Group, LLP has heretofore been substituted as Trustee by instrument dated February 28, 2023 and recorded in the aforesaid Chancery Clerk's Office in Instrument No. 202300369; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Nationstar Mortgage LLC, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, LOGS Legal Group, LLP, Substituted Trustee in said deed of trust, will on October 2, 2025 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the West Door of the County Courthouse of Clarke County, located at 101 Archusa Avenue, Quitman, MS 39355, to the highest and best bidder for cash or certified funds the following described property situated in Clarke County, State of Mississippi, to-wit:
A parcel of land lying and being situated in the NE 1/4 of the SE1/4 of Section 17, Township 3 North, Range 16 East, Clarke County, Mississippi and being more particularly described as follows, to-wit.
Commencing at the NE Corner of the NE 1/4 of the SE1/4 of Section 17, Township 3 North, Range 16 East, Clarke County, Mississippi; thence run South along the East Line of the NE 1/4 of the SE 1/4 of said Section 17 for a distance of 744.82 feet to a 1/2" Iron Pin Set, said point being the Point of Beginning of the herein described parcel of land; thence run West for a distance of 547.33 feet to a 1/2" Iron Pin Set; thence run South for a distance of 370.00 feet to a1/2" Iron Pin Set; thence run East for a distance of 197.11 feet to a 1/2" Iron Pin Set; thence run S 61°25'16" E for a distance of 232.72 feet to a 1/2" Iron Pin Set on the Northwesterly Right-of-Way Line of Clarke County Road 140; thence run N 12°56'16" E along said Right-of-Way Line for a distance of 10.88 feet; thence run Northeasterly along said Right-of-Way Line, said line being in a curve to the right having a radius of 953.98 feet, a chord that bears N 23°42'40" E, and a chord length of 356.65 feet for an arc length of 358.76 feet to a 1/2" Iron Pin Set on the East Line of the NE 1/4 of the SE1/4 of said Section 17; thence run North along the East Line of the NE 1/4 of the SE 1/4 of said Section 17 for a distance of 144.18 feet to the Point of Beginning.
The herein-above-described parcel of land contains 4.62 acres, more or less.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
