WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on April 1, 1986, did adopt Ordinance No. 67, with regard to the services of the Combined Waterworks and Sewerage System of the Town of Stonewall, Mississippi; and
WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on October 6, 1987, did adopt Ordinance No. 77 by which Ordinance No. 67 was amended; and
WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on July 2, 1991, did adopt Ordinance No. 83 by which Ordinance no. 77 was amended in such manner so as to further amend Ordinance No. 67; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on March 2, 2004, did adopt Ordinance No. 110 by which Ordinance No. 83 was amended in such manner so as to further amend Ordinance No. 67 and Ordinance No. 77; and
WHEREAS, the Mayor and the Board of Aldermen of the town of Stonewall, Mississippi, on September 6, 2005, did adopt Ordinance No. 111 by which Ordinance No. 110 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77 and Ordinance No. 83; and
WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on November 7, 2006, did adopt Ordinance No. 112 by which Ordinance No. 111 was amended in such manner so as to further amend Ordinance No. 67, Ordinance no. 77, Ordinance No. 83 and Ordinance No. 110; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on November 2, 2010, did adopt Ordinance No. 113 by which Ordinance No. 112 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110 and Ordinance No. 111; and
WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on February 1, 2011, did adopt Ordinance No. 114 by which Ordinance no. 113 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, and Ordinance 112; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on September 3, 2013, did adopt Ordinance No. 118 by which Ordinance No. 114 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112 and Ordinance No. 113; and
WHEREAS, the Mayor and Board of Aldermen of the Town of Stonewall, Mississippi, on September 26, 2014, did adopt ordinance No. 121 by which Ordinance No. 118 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No.113, Ordinance No. 114; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on February 23, 2015, did adopt Ordinance No. 123, by which Ordinance No. 121 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114 and Ordinance No. 118; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on August 2, 2016, did adopt Ordinance No. 125, by which Ordinance No. 123 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114, Ordinance No. 118 and Ordinance No. 121; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on May 2, 2017, did adopt Ordinance No. 127, by which Ordinance No. 125 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114, Ordinance No. 118, Ordinance No. 121, Ordinance No. 123 and Ordinance No. 125; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on May 9, 2017, did adopt Ordinance No. 128 by which Ordinance No. 127 was amended in such manner so as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114 Ordinance No. 118, Ordinance No. 121, Ordinance No. 123, Ordinance No. 125 and Ordinance No. 127; and
WHEREAS, the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, on November 7, 2017, did adopt Ordinance No. 129 by which Ordinance No. 128 was amended in such manner as to further amend Ordinance No. 67, Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114, Ordinance No. 118, Ordinance No. 121, Ordinance No. 123, Ordinance No. 125, Ordinance No. 127 and Ordinance No. 128; and
WHEREAS, the health, welfare and safety of the citizens of the Town of Stonewall, Mississippi is enhanced in a positive way by the maintenance of an efficient and financially sound combined waterworks and sewerage system; and
WHEREAS, it is now necessary and proper that the respective provisions of the said Ordinance No. 67, the said ordinance No. 77, the said Ordinance No. 83, the said Ordinance No. 110, the said Ordinance No. 111, the said Ordinance No. 112, the said Ordinance No.113, the said Ordinance No. 114, the said Ordinance No. 118, the said Ordinance No. 121, the said Ordinance No. 123, the said Ordinance No. 125, the said Ordinance No. 127, the said Ordinance No. 128 and the said provisions of Ordinance No. 129 now further be amended so as to provide for appropriate new and adjusted rates and other charges for the service of the combined waterworks and sewerage system of the Town of Stonewall, and to provide for the implementation and enforcement of certain policies and procedures with respect thereto, all for the benefit of the health, welfare and safety of the citizens thereof.
NOW THEREFORE, BE IT ORDAINED by the Mayor and the Board of Aldermen of the Town of Stonewall, Mississippi, as follows:
Section 1. That Section 1 of Ordinance No. 77, Ordinance No. 83, Ordinance No. 110, Ordinance No. 111, Ordinance No. 112, Ordinance No. 113, Ordinance No. 114, Ordinance No. 118, Ordinance No. 121, Ordinance No. 123, Ordinance No. 125, Ordinance No. 127, Ordinance No. 128 and Ordinance No. 129, all now be and the same are hereby deleted in their entirety, and there be substituted in lieu thereof the following as a new Section 1 of each thereof:
“Section 1. That Section 2 of Ordinance No. 67, dated April 1, 1986, be and said section is hereby deleted in its entirety and there be substituted in lieu thereof the following:
“Section 2. That from and after the effective date hereof, water and sewerage rates and charges to both residential and commercial customers or users of the Combined Waterworks and Sewerage System, or any additions or expansions thereof, of the Town of Stonewall, Mississippi shall be as follows;
WATER AND SEWER RATES
GALLONS - WATER - SEWER
0 – 1,000 gallons - $6.50 - $6.50
Per 1,000 gallons and above - $6.50 - $6.50
Any commercial business situated within the Town of Stonewall that consumes more than 50,000 gallons of water per month, at the discretion of the Board of Aldermen, may be given a discounted sewer rate on the actual percentage of water that is not passed to the sewer system and treated by the Town of Stonewall. The maximum discount that may be given hereto is 50%.
The calculation formula to be used for any such discounted commercial sewer rate shall be the “Total gallons at meter divided by the total actual gallons calculated and certified by the designated representative of the commercial business (i.e., Plant Engineer or designee) that will not be passed through and treated by the Town’s sewer system times 100%.” (The said calculation and certification may include both water which will be used in processing and water reasonably calculated to be evaporated). In order to qualify for consideration for a discounted commercial sewer rate, the particular commercial business shall certify to the Town, not less frequently than annually, the actual usage as measured by said commercial business.
Any commercial business granted a discounted commercial sewer rate further must notify the Town of Stonewall upon any change in calculations so the rate may be appropriately adjusted.
Any business that conducts fire protection sprinkler test may apply to the Board for a 100% adjustment to the sewer percentage of the monthly bill equal to the amount of water used for the sprinkler test.

Additional Sewer Treat Surcharge - Actual cost of chemicals and labor required for additional sewer treatment made necessary as a result of customer use.
POLICIES AND PROCEDURES
The following policies and procedures shall be implemented and enforced:
All new applicants for service from the combined waterworks and sewerage system of the Town of Stonewall shall complete and submit to the Town Clerk a written application therefor, in such form as shall be approved by the Mayor and the Board of Aldermen.
Industrial process waste will not be permitted unless adequately treated.
Town personnel shall read all meters on or about the time period between the tenth and fifteenth days of each calendar month. Billings shall be prepared therefrom and in due course thereafter submitted to customers for payment. Payment of all charges for water and sewer service reflected on bills already submitted by the Town to customers shall be due and payable
in full not later than the tenth day of each calendar month. All accounts are payable by United States Mail, in person at the Town Hall, via phone payment with credit card or online.
The Town shall assess and collect a late charge equal to ten percent (10%) of the outstanding balance on all bills paid after the tenth day of the calendar month.
In the event a bill for water and sewer service remains unpaid as of the 15th day of the month, Town personnel shall discontinue service to the customer on the next business day thereafter.
In the event the Town discontinues service to a customer for delinquency of an account, as aforesaid, a $60.00 reconnect fee shall be assessed for reconnecting service after service has been cut off pursuant to this action.
In the event a delinquent account is referred to collection, the Town shall be entitled to recover all costs of collection, including collection fees, court costs and a reasonable attorney’s fee.
All applicants for service from the combined waterworks and sewerage System of the Town of Stonewall, shall agree in writing to follow the guidelines set by the Mississippi State Department of Health regarding onsite wastewater disposal.
No residential or commercial customer of the Town shall hook up a water service line or otherwise provide unauthorized water service to a non-metered residential or commercial structure through a single water meter. Upon violation, said customer shall immediately discontinue such non-metered hook-up service and shall be subject to a fine of up to $50.00 per day for each violation.
There will be a one-time water leak adjustment per customer per fiscal year (October 1 through September 30). The adjustment will be on the sewer. All Customers requesting adjustment must provide an itemized receipt with signature from persons who repaired the leak. The Board must approve all adjustments.
All water customers are recommended to provide an emergency cut-off between the meter and their structure to minimize potential problems with the electronic water meter.
The Town will not make water adjustments for filling swimming pools, irrigating gardens or lawns, or washing vehicles.
A seal will be placed on the water meter when the water is turned off by the Town. If the seal is found to be broken, the customer whose name is on the account shall be responsible for paying the $75.00 tampering fee along with all other applicable fees.
SECTION 2. The Ordinances shall take effect and be in force one (1) month after its Passage, and all Ordinances in conflict herewith be and the same are hereby repealed.
